I found my copyrighted images on Polyvore. How did they get there?

The Polyvore user community imports images from other websites into Polyvore using the clipper tool. Most people use the clipper to import cool clothing that they want to include in their fashion collages.

How are my images being used on Polyvore?

Polyvore is a community of fashionistas and designers who create outfits and collages (we call them "sets") by mixing and matching images in the Polyvore editor.

For example, below is a fashion collage composed of 9 images from different sites. The scarf is from TopShop.com and the bangles are from Forever21.com. You can see this set on Polyvore here.

Polyvore always links back to the original site that the images came from. People click on these links if they want to buy the product or learn more about it. This results in hundreds of thousands of clicks to other websites from Polyvore every month.

How can I get my images removed from Polyvore?

Polyvore takes copyright issues very seriously. If you find your copyrighted images on Polyvore and don't want them there, please let us know and we will take them down within 1 business day. To make it as simple as possible, copyright owners can submit takedown requests directly through our online form.

To file a copyright infringement notification with us, you will need to send a written communication that includes substantially the following (please consult your legal counsel or see Section 512(c)(3) of the Copyright Act to confirm these requirements):

  1. Identify in sufficient detail the copyrighted work that you believe has been infringed upon.
  2. Identify the material that you claim is infringing the copyrighted work listed in item. You must include URLs for the material you want taken down.
  3. Provide your full name, address, telephone number, and email address, so that Polyvore can contact you.
  4. Include the following statement: "I have a good faith belief that use of the copyrighted materials described above as allegedly infringing is not authorized by the copyright owner, its agent, or the law."
  5. Include the following statement: "I swear, under penalty of perjury, that the information in the notification is accurate and that I am the copyright owner or am authorized to act on behalf of the owner of an exclusive right that is allegedly infringed."
  6. Sign the notice, proving that you are a person authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.

Please also note that under Section 512(f) any person who knowingly materially misrepresents that material or activity is infringing may be subject to liability.

How do I file a counter notification?

The process for counter-notifications is governed by Section 512(g) of the Digital Millennium Copyright Act. To file a counter notification with us, you will need to send a written communication that includes substantially the following:

  1. Identify the specific URLs of material that Polyvore has removed or to which Polyvore has disabled access.
  2. Provide your full name, address, telephone number, and email address, and the username of your Polyvore account.
  3. Provide a statement that you consent to the jurisdiction of Federal District Court for the judicial district in which your address is located (or Santa Clara County, California if your address is outside of the United States), and that you will accept service of process from the person who provided notification under subsection (c)(1)(C) or an agent of such person.
  4. Include the following statement: "I swear, under penalty of perjury, that I have a good faith belief that the material was removed or disabled as a result of a mistake or misidentification of the material to be removed or disabled."
  5. Sign the notice.

After we receive your counter-notification, we will forward it to the party who submitted the original claim of copyright infringement. Please note that when we forward the counter-notification, it includes your personal information. By submitting a counter-notification, you consent to having your information revealed in this way. We will not forward the counter-notification to any party other than the original claimant.

After we send out the counter-notification, the claimant must then notify us within 10 days that he or she has filed an action seeking a court order to restrain you from engaging in infringing activity relating to the material on Polyvore. If we receive such notification we will be unable to restore the material. If we do not receive such notification, we may reinstate the material.

Please note that under Section 512(f) of the Copyright Act, any person who knowingly materially misrepresents that material or activity was removed or disabled by mistake or misidentification may be subject to liability.
